Registers of Deeds Can Now Issue Adoptive Birth Certificates

A new North Carolina law now allows Registers of Deeds across the state to issue certified copies of adoptive birth certificates. 

Prior to the new law, which went into effect on January 1, 2026, adoptees could only obtain copies of their adoptive birth certificates through the North Carolina Office of Vital Records in Raleigh. 

“In our office, we are always looking for ways to better serve our customers,” said Caldwell County Register of Deeds Wayne Rash. “This law allows our staff to meet the needs of adoptees and their families by providing timely, convenient access to certified records close to home, while still protecting sensitive information.” 

Under the law, certified copies of adoptive birth certificates may be issued to the following individuals: 

  • The adoptee
  • The adoptee’s children
  • The adoptive parents
  • The adoptee’s spouse, brothers, or sisters

However, original birth certificates issued prior to adoption, as well as associated adoption records will remain sealed and are not subject to inspection or release. 

To assist with implementation of the new law, the North Carolina Office of Vital Records will provide Adoption Security training to Registers of Deeds and their staff members statewide. Training will focus on proper issuance procedures, privacy protections, secure record handling, confidentiality requirements, and updated electronic access and digitization standards.
